1. Acceptance of Terms

By accessing or using any ContentScale service — including the free ContentScore scanner at app.contentscale.site, the ContentScale website at contentscale.site, Content Recovery services, or AI Lead Generation via Otto — you agree to be bound by these Terms & Conditions.

If you do not agree, do not use our services. These terms constitute a legally binding agreement between you and Ottmar J.G. Francisca, operating as ContentScale, Amsterdam, Netherlands.

2. Our Services

ContentScale provides three services:

• Free ContentScore Scanner — 100-point GRAAF audit for any URL. No account required.
• Content Recovery — professional monthly service at €250/month per client. Includes GRAAF audit, full content rewrite, schema markup, and WhatsApp support.
• AI Lead Generation via Otto — automated outbound calling service at €250/month per client. Otto calls prospects, discloses AI identity, and collects email consent.

All services are operated personally by Ottmar J.G. Francisca. No subcontractors handle client deliverables without prior disclosure.

3. Free ContentScore Scanner

What it does

The scanner analyses publicly accessible web pages and returns a 100-point ContentScore based on the GRAAF Framework (Genuinely Credible, Relevant, Actionable, Accurate, Fresh), CRAFT methodology, and Technical SEO signals.

Limitations

• The ContentScore is an advisory indicator, not a guarantee of search ranking
• Scores are based on content signals detectable at the time of scan
• We do not guarantee scan availability 24/7 — maintenance windows may occur
• Rate limiting applies to prevent abuse

Acceptable scanner use

• You may only scan URLs you own or have permission to scan
• Automated bulk scanning without prior agreement is prohibited
• Scan results may not be resold or republished without attribution

4. Paid Services

Content Recovery — €250/month per client

• 2 pages fully optimised per month using the GRAAF Framework
• Includes: audit, full rewrite, schema markup, AI Overview optimisation, WhatsApp support throughout
• Ottmar personally handles all delivery
• Results are realistic but not guaranteed — SEO recovery depends on Google’s algorithm, which is outside our control
• Our published success rate (78%) is based on historical client data and is not a guarantee of your specific result

AI Lead Generation — €250/month per client

• Lead Crawler identifies 200–500 target businesses per campaign
• Otto calls each prospect and discloses AI identity (EU AI Act Article 50 compliant)
• Interested prospects who provide email consent are delivered to the client
• Call pickup rates (published 65%) are averages and vary by industry and region
• Client is responsible for ensuring their target industry and geography comply with applicable telemarketing laws

White-Label Reselling

Partners who resell ContentScale services under their own brand are responsible for their client relationships, billing, and local legal compliance. ContentScale’s liability is limited to the services delivered to the reselling partner.

5. Payment & Cancellation

Payment

• Paid services are billed monthly in advance
• Payment is due before service delivery begins for the month
• Accepted methods: bank transfer, PayPal (agreed per client)
• All prices are in EUR and exclude VAT where applicable

Cancellation

• No contract, no minimum term. Cancel any time via WhatsApp or email.
• Cancellations received before the next billing date take effect immediately
• No refunds for the current month once work has commenced
• Partial month refunds may be issued at Ottmar’s discretion for exceptional circumstances

6. AI Calling Service (Otto)

Otto is an AI voice assistant that makes outbound calls on behalf of clients. By using this service, you confirm:

• You have the legal right to contact the businesses in your target list
• Your campaign complies with applicable telemarketing laws in your jurisdiction (GDPR, FCC, TCPA, or equivalent)
• The businesses being called are legally contactable for B2B marketing purposes
• You will not use Otto to contact individuals on national do-not-call registries

7. Acceptable Use

You agree NOT to use any ContentScale service to:

• Scan, crawl, or scrape websites without permission
• Attempt to bypass rate limits or authentication
• Reverse engineer the GRAAF scoring algorithm
• Resell ContentScore data without written permission
• Harass, spam, or mislead any individuals
• Violate any applicable law or regulation
• Conduct fraudulent or deceptive SEO practices
• Use Otto to impersonate a human without disclosure

Violation of these terms may result in immediate service termination without refund.

8. Intellectual Property

ContentScale IP

The GRAAF Framework, CRAFT methodology, ContentScore algorithm, Otto voice system, all software, designs, and written content on contentscale.site and app.contentscale.site are the intellectual property of Ottmar J.G. Francisca. All rights reserved.

Your content

You retain all rights to the content we analyse or rewrite for you. By submitting a URL for scanning, you grant ContentScale a limited, non-exclusive licence to fetch and analyse that page for the purpose of delivering your ContentScore.

Leaderboard

By appearing on the ContentScale leaderboard, you grant ContentScale the right to display your company name, URL, and score publicly. You may request removal at any time.

9. Disclaimer of Warranties

ContentScale services are provided “as is” and “as available” without warranties of any kind, express or implied.

We do not warrant that:

• Services will be uninterrupted or error-free
• ContentScores will predict actual search rankings
• Content Recovery will result in specific traffic improvements
• Lead Generation will achieve specific conversion rates
• Results from our services will meet your specific business objectives

10. Limitation of Liability

To the maximum extent permitted by Dutch law, ContentScale’s total liability for any claim arising from these terms or our services is limited to the amount you paid us in the 3 months preceding the claim.

ContentScale is not liable for:

• Indirect, incidental, or consequential damages
• Lost profits or lost data
• Third-party actions (including Google algorithm changes)
• Downtime of third-party services (Railway, Neon, Vapi, SendGrid)
• Results that depend on factors outside our control

Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.

11. Indemnification

You agree to indemnify and hold harmless Ottmar J.G. Francisca and ContentScale from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these terms
• Your use of Otto to make unlawful calls
• Your content submitted for analysis
• Your violation of applicable law

12. Termination

ContentScale may suspend or terminate your access to any service immediately, without notice, if you:

• Violate these Terms & Conditions
• Use services for illegal purposes
• Fail to pay for paid services
• Engage in abusive behaviour toward Ottmar or ContentScale

Upon termination, your right to use ContentScale services ceases immediately. Data deletion follows our Privacy Policy retention schedule.

13. Governing Law & Disputes

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved exclusively by the competent court in Amsterdam, Netherlands.

For EU consumers: you retain the right to bring proceedings in the courts of your country of residence. The European Commission’s Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

We prefer to resolve disputes amicably. Contact info@contentscale.site before initiating formal proceedings — most issues can be resolved within 5 business days.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. Material changes will be communicated via email (for paid clients) or via a notice on contentscale.site at least 14 days before taking effect.

Continued use of our services after changes take effect constitutes acceptance of the new terms. If you do not accept the changes, you may cancel your service before they take effect.
